Government Regulation

Every business owner or manager must address some part of an overlapping — and sometimes bewildering — web of federal and state regulations. These regulations affect almost every aspect of day-to-day operations, from employment, land use, and environmental issues to data privacy and protection, as well as industry-specific processes and transactions. The interplay between federal and state regulations, and the different and sometimes contradictory regulations in effect in each state, only add to the complexity.

Compliance and Enforcement
We assist clients in understanding, and ensuring compliance with, the federal and state regulations affecting their businesses and governing their industries. We also advise them in working through any necessary approval and rulemaking processes. In the event of a government enforcement action, we represent individuals and businesses before federal and state agencies and regulatory commissions, including the U.S. Securities and Exchange Commission, federal and state environmental agencies, state public utility commissions, and business and professional licensing boards, and in judicial enforcement and penalty proceedings.

Experience on Both Sides
Our clients benefit because we have decades of experience in addressing the regulatory process from both sides. Our attorneys have served in state and federal government, working for a governor and a senator, in the U.S. Attorney’s Office in the U.S. Department of Justice Honors Program, and as senior litigation counsel for the U.S. Environmental Protection Agency. We have worked as in-house regulatory counsel for companies in highly regulated industries, and we regularly represent clients in administrative proceedings and related litigation. Drawing on our deep expertise in administrative law, and our experience in working closely and effectively with government officials, we understand what is required for compliance and how to respond to administrative and judicial proceedings.
